Children Under the Age of 18

• Your contacts. You can use the contact upload feature and provide us, if permitted by applicable laws, with the names and phone numbers in your address book. If any of your contacts aren’t yet using our Services, we’ll manage this information for you in a way that ensures those contacts cannot be identified or contacted  by us. You can create, join, or get added to groups and broadcast lists, and such groups and lists get associated with your account information only by contacts or in workspaces joined.
• Certain content or materials that you want to post, submit, upload, publish, display, or transmit to other individuals via the Services (the “Messages”);
• About your internet connection, the equipment you use to access our Service, and usage details;
• Business or commercial account information;
• Technical information such as authentication and session tokens.

We collect this information:

• Directly from you when you provide it to us.
• Automatically as you navigate through the Service. Information collected automatically may include usage details, IP addresses, and information collected through cookies, and other tracking technologies.
• Send Messages via the Service.

Uploaded files

• Uploaded files are only accessible to user’s invited to the workspace.
• Wavelength Labs will not use uploaded files (from Desktop, Google Drive, Dropbox or Sharepoint) to train a general purpose AI or LLM
• Admins can delete individual uploaded files or the entire workspace and all files and messages will be deleted and inaccessible

Disclosure of Your Information

We may disclose aggregated information about our users without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

• To our subsidiaries and affiliates.
• To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Airwave’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Airwave about our Service users is among the assets transferred.
• To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To fulfill the purpose for which you provide it. For example, when using our Service, you may contact us to request information about Airwave or our products and services. You may also use the Service to send or receive Messages. Members or other users of our Service may also be able to sign up for seminars, request specific information about programs or register or apply for various programs or services. In choosing these options, you may provide us with information that we use to send you the information, evaluate and process your request or application or provide you with the services you request.
• For any other purpose disclosed by us when you provide the information.
• With your consent.
• We may also use for other purposes and disclose to third parties information that does not constitute personally identifiable information.

• To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
• To enforce or apply our terms of use Airwave.com/terms and other agreements.
• If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Airwave, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Access to Messages and Data Retention

Airwave does not ‘read’ your Messages. Messages that are sent or received are encrypted and decrypted by end-user devices, and we cannot otherwise access the content of your Messages or calls.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Please consult your browser’s documentation to learn how. Note that certain portions of the Service may not operate as intended if you refuse certain cookies..
• Promotional Offers from Airwave. If you do not wish to have your email address/contact information used by Airwave to promote our own products or services, you can opt-out by using the UNSUBSCRIBE feature in the email you receive from Airwave, which will remove you from future email distributions. This opt out does not apply to information provided to Airwave as a result of a transaction, or activity on the Service.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way.

Updating Your Information

If you are a user who has a registered account on the Service, you can review and change some of your Personal Information by logging into the Service and visiting your account details page, or contacting us at the information below.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page or with a notice that the privacy policy has been updated on the Service home page. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Please be aware that under certain circumstances, the CCPA/CPRA may limit your exercise of these rights.

Response Timing and Format.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

Non-Discrimination.

We will not discriminate against you for exercising any of your CCPA/CPRA rights. Unless permitted by the CCPA/CPRA, we will not:

• Deny you goods or services;
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
• Provide you a different level or quality of goods or services; or
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
